Terms of Service — GamersGoneWild

Welcome to GamersGoneWild ("GGW", "we", "us"). These Terms of Service ("Terms") form a binding agreement between you and GamersGoneWild governing your access to and use of gamersgonewild.life, gamersgonewild.com, and any related services, applications, and APIs (collectively, the "Service"). By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Age

GamersGoneWild is a gaming, cosplay, and community live-streaming platform — not an adult website. It operates a two-tier model: a public tier dedicated to gaming, cosplay, and community content (no creator nudity, no sexual content) and a paywalled, ID-verified 18+ subscriber tier where creators offer exclusive perks to verified-adult fans. Public live streams are general-audience and viewable without an account. To create an account you must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater). Subscribing to a creator, tipping, or topping up a wallet requires a valid major credit card; because major card issuers already require cardholders to be adults, payment itself serves as our adult-age check for paying viewers. Creators and anyone who appears on camera must be at least 18 and complete identity and age verification before going live on either tier — the AI stream moderator flags any unverified person on screen and cuts the stream. Creators must additionally complete payout verification with our payment processor for tax, AML, and fraud-prevention compliance.

Mature content on the subscriber tier (optional). A creator may choose to publish mature content on their 18+ subscriber tier. Where they do, it is permitted only behind the paywall, only between ID-verified adults, and never on the public tier. See the § 2257 statement and the Creator Agreement for the rules that apply.

2. Accounts

You must provide accurate, complete information when creating an account and keep it up to date.
You are responsible for safeguarding your credentials and for all activity that occurs under your account.
One account per person. We may suspend or terminate accounts found to be duplicative, fraudulent, or shared.
You must immediately notify us at security@gamersgonewild.life of any unauthorized use.

3. The Service

GGW is a live-streaming and on-demand video platform that lets viewers discover, watch, chat with, tip, and subscribe to creators. Some features are free; others require payment. We may add, modify, or discontinue features at any time.

4. User Conduct & Acceptable Use

You agree to follow our Community Guidelines and Acceptable Use Policy. Without limitation, you will not:

Upload, stream, or transmit content that is illegal, defamatory, harassing, threatening, hateful, or that depicts or promotes child sexual abuse material ("CSAM"), non-consensual intimate imagery, trafficking, or violence;
Impersonate another person or misrepresent your affiliation;
Reverse engineer, scrape, or interfere with the Service or any user's experience;
Use the Service to launder funds, evade taxes, or violate sanctions or export controls;
Circumvent payment, age-gating, geo-blocking, or moderation systems.

5. User Content & License

You retain ownership of the content you create or upload ("User Content"). By submitting User Content you grant GGW a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as transcoding and thumbnails), publicly perform, publicly display, and distribute that User Content solely for the purpose of operating, promoting, and improving the Service. This license terminates when you delete the User Content, except for backup copies retained for a commercially reasonable period and copies others have lawfully reshared.

You represent that you own or have all necessary rights, releases, and consents (including model releases where applicable) for all User Content you submit.

6. Payments, Tips & Subscriptions

Purchases (subs, tips, tokens) are processed by our third-party payment partners and are subject to their terms.
All purchases are final and non-refundable except as required by law or as set out in our Refund Policy.
Subscriptions auto-renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
Creator earnings, payouts, fees, and taxes are governed by the Creator Agreement.

7. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by GGW or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. We respond to copyright complaints under our DMCA & Copyright Policy.

8. Termination

We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms, suspected illegal activity, or risk to the Service or our users. You may close your account at any time. Sections that by their nature should survive termination (IP, indemnity, disclaimers, limitations of liability, dispute resolution) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GGW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO GGW IN THE 12 MONTHS PRECEDING THE CLAIM AND (B) USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless GGW and its officers, employees, and agents from any claim, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your breach of these Terms.

12. Dispute Resolution & Arbitration

Except where prohibited, you and GGW agree to resolve any dispute through binding individual arbitration administered by JAMS under its applicable rules, and you waive any right to a jury trial or to participate in a class action. Either party may bring claims in small-claims court for qualifying disputes. The seat of arbitration is the state of GGW's principal place of business.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles.

14. Changes

We may update these Terms from time to time. Material changes will be announced via the Service or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Verification, moderation & records

Every creator must complete government-ID verification at /verify-identity before going live or being paid. All sexually-explicit productions are catalogued in the 18 U.S.C. §2257 records office; see our §2257 statement. Public streams are continuously sampled by our AI Watch system for nudity, sexual content, violence, weapons, drugs, self-harm, illegal activity, and verified-creator-on-screen presence. Private (subscriber and 1:1) streams are sampled by Identity Watch which verifies the streamer is the ID-verified creator and auto-pauses the stream if any additional person enters the frame. Every reviewer action against your account is written to an immutable admin audit log and may be produced in response to lawful requests as described in our Law Enforcement Guidelines.
